These Terms of Service (“Terms”) govern your access to and use of briellev.com, including all information, products, services, features, and purchases offered by BRIELLEV (“BRIELLEV,” “we,” “us,” or “our”).

By visiting our website, creating an account, submitting information, or purchasing a product, you agree to these Terms and all policies referenced in them. If you do not agree, please do not use our website.

1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction. If you are under the age of legal majority, you may use the website only with the permission and supervision of a parent or legal guardian.

If you use the website on behalf of another person, company, or organization, you represent that you have authority to accept these Terms on their behalf.

2. Online Store Terms

You may use our website and products only for lawful, personal, and non-commercial purposes unless BRIELLEV provides written authorization otherwise.

You may not use our website or products to violate laws, infringe another party’s rights, transmit malicious code, interfere with website security, collect information without authorization, or engage in fraudulent purchases, returns, reviews, promotions, or payment disputes.

A violation may result in order cancellation, account suspension, refusal of service, or other appropriate action.

3. Product Information

We make reasonable efforts to display product descriptions, photographs, colors, dimensions, specifications, materials, and features accurately.

However:

• Colors may appear differently depending on the screen or device.
• Measurements may have reasonable manufacturing variations.
• Packaging may change without affecting the product.
• Handmade, printed, seasonal, or decorative products may vary slightly.
• Product photographs may include props not included with the purchase.

4. Product Availability

All products are subject to availability. Adding an item to your shopping cart does not reserve it.

We may:

• Limit purchase quantities
• Discontinue products
• Restrict sales by customer, location, or jurisdiction
• Correct inventory errors
• Cancel items that become unavailable
• Refuse orders that appear fraudulent or intended for unauthorized resale

If a paid item becomes unavailable, we will notify you and refund the amount paid for that item.

5. Orders and Acceptance

Submitting an order is an offer to purchase products under these Terms. An automated order-confirmation email acknowledges that we received the order but does not necessarily mean it has been accepted.

An order is generally accepted when it enters fulfillment or is shipped. Before acceptance, we may verify payment, inventory, contact details, shipping information, and fraud indicators.

We may reject or cancel an order because of:

• Product or inventory errors
• Incorrect prices or promotions
• Payment failure
• Suspected fraud or unauthorized activity
• Shipping restrictions
• Excessive or unusual quantities
• Violation of these Terms
• Circumstances that make fulfillment impractical or unlawful

If we cancel a paid order, we will refund the canceled amount to the original payment method.

6. Account Information

You agree to provide accurate, complete, and current information when placing an order or creating an account.

You are responsible for:

• Reviewing activity performed through your account
• Notifying us promptly of suspected unauthorized use

Product prices are displayed in the currency shown on the website. Prices may change without notice, but a change will not normally affect an order already accepted.

The total amount shown at checkout may include:

For international purchases, additional duties, taxes, customs charges, or brokerage fees may be collected by local authorities or carriers. Unless checkout states otherwise, those charges are the customer’s responsibility.

We try to keep product, price, promotion, and availability information accurate. However, errors may occasionally occur.

If an obvious pricing or product-information error affects an order, we may contact you to:

• Confirm the order at the corrected price
• Offer an alternative
• Cancel the affected item and issue a refund

We are not required to fulfill an order at an obviously incorrect price where permitted by law.

9. Payment

By submitting payment information, you represent that you are authorized to use the selected payment method.

You authorize our payment providers to charge the total displayed at checkout. Orders may be delayed or canceled if payment cannot be authorized, appears fraudulent, or requires additional verification.

Payment information is handled by authorized payment providers under their applicable terms and privacy practices.

10. Promotions and Discount Codes

Promotions and discount codes are subject to their stated terms, expiration dates, eligible products, minimum purchase requirements, and usage limits.

Unless expressly stated otherwise:

• Only one discount code may be used per order.
• Discounts cannot be exchanged for cash.
• Discounts cannot be applied after an order is completed.
• Promotions cannot be transferred or resold.
• Gift cards and non-merchandise charges may be excluded.
• Discounts may not apply to previous purchases.

We may cancel or restrict a promotion affected by technical error, unauthorized distribution, abuse, manipulation, or fraud.

11. Shipping and Delivery

Orders are governed by our Shipping Policy, which forms part of these Terms.

Eligible U.S. orders with a merchandise subtotal of $79 USD or more receive free standard shipping after discounts and before taxes and shipping charges.

Processing and delivery times are estimates unless expressly guaranteed. Weather, carrier disruption, holidays, customs, incorrect addresses, security reviews, and events outside our reasonable control may delay delivery.

Customers are responsible for providing a complete and accurate shipping address. Additional charges caused by an incorrect, refused, or undeliverable address may be the customer’s responsibility where permitted by law.

12. Returns, Refunds, and Exchanges

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Eligible return requests must generally be submitted within 30 calendar days after delivery. Products must satisfy the stated return conditions.

Certain products may be non-returnable for hygiene, safety, customization, perishability, digital-delivery, or final-sale reasons. Statutory rights concerning defective or misdescribed products are not limited.

Refunds are issued to the original payment method after the return is received, inspected, and approved.

13. Cancellations

Contact us immediately if you need to cancel an order. We will try to assist, but cancellation is not guaranteed after processing begins.

Once an order ships, it must follow the applicable return procedure. If we successfully cancel a paid, unshipped order, the canceled amount will be refunded to the original payment method.

14. BRIELLEV Giving Commitment

BRIELLEV commits 10% of the qualifying order value from eligible completed purchases to initiatives supporting children and families.

Unless expressly stated otherwise:

• The qualifying amount is the merchandise subtotal after discounts.
• Taxes, shipping, duties, tips, and gift-card purchases are excluded.
• Canceled, fully refunded, fraudulent, and chargeback orders do not qualify.
• Partially refunded orders are recalculated using the final retained merchandise subtotal.
• Contributions may be reviewed and allocated periodically after return and dispute periods close.

The contribution is funded by BRIELLEV and is not a tax-deductible charitable donation made by the customer.

Customer totals, community goals, projected impact, and donation figures labeled as estimates are illustrative and do not represent completed donations. Verified contribution information will be identified separately on our Our Impact page.

15. Product Use and Safety

Customers must read and follow all product instructions, warnings, age recommendations, care directions, assembly instructions, and safety notices.

Products must not be used for an unintended or unlawful purpose. BRIELLEV is not responsible for damage caused by misuse, improper assembly, unauthorized modification, failure to follow instructions, or ordinary wear and tear, except where responsibility cannot legally be excluded.

If a product appears damaged or unsafe, stop using it and contact us.

16. Customer Reviews and Submissions

If you submit a review, photograph, video, comment, suggestion, or other content, you confirm that:

• You own the content or have permission to submit it.
• The content is accurate and based on a genuine experience.
• The content does not infringe intellectual-property, privacy, or publicity rights.
• The content is not unlawful, threatening, defamatory, deceptive, or obscene.
• The content does not contain malware, spam, or undisclosed advertising.

You grant BRIELLEV a non-exclusive, worldwide, royalty-free license to host, reproduce, publish, display, format, and use submitted content for website, customer-service, promotional, and business purposes, subject to applicable law and our Privacy Policy.

We may moderate or remove content that violates these Terms but are not required to publish every submission.

17. Intellectual Property

The website and its content, including the BRIELLEV name, logos, graphics, photographs, videos, text, layouts, product presentations, and software, are owned by or licensed to BRIELLEV and protected by applicable intellectual-property laws.

You may access the website for personal shopping purposes. You may not reproduce, distribute, sell, modify, scrape, republish, or commercially exploit website content without written permission.

No right, title, or license is granted except the limited right to use the website under these Terms.

18. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, carriers, social networks, analytics providers, and advertising platforms.

Third parties operate under their own terms and privacy policies. BRIELLEV does not control independent third-party services and is not responsible for their content, availability, security, or practices except where applicable law provides otherwise.

A third-party link does not necessarily mean BRIELLEV endorses that party.

19. Prohibited Conduct

You may not:

• Use the website for unlawful or fraudulent activity
• Provide false account, payment, delivery, or return information
• Attempt unauthorized access to accounts or systems
• Circumvent security or purchase restrictions
• Introduce viruses, malicious code, or disruptive technologies
• Scrape, crawl, copy, or extract website data without authorization
• Infringe intellectual-property or privacy rights
• Impersonate another person or organization
• Manipulate reviews, promotions, referrals, refunds, or chargebacks
• Interfere with another customer’s use of the website
• Resell products in a way that falsely implies authorization by BRIELLEV

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

We do not guarantee that website access will always be uninterrupted, secure, or error-free. Product warranties, if any, will be stated on the applicable product page or documentation.

Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by law, BRIELLEV will not be responsible for indirect, incidental, special, punitive, or consequential losses arising from use of the website, delayed access, third-party services, or purchased products.

Any limitation applies only to the extent permitted in the customer’s jurisdiction. Nothing in these Terms limits liability for fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot lawfully be limited.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold BRIELLEV harmless from third-party claims, losses, or reasonable expenses resulting from your unlawful use of the website, violation of these Terms, infringement of another party’s rights, or fraudulent conduct.

This section does not apply where such an obligation is prohibited by applicable consumer law.

23. Privacy

Our collection and use of personal information are described in our Privacy Policy, which forms part of these Terms.

By using our website, you acknowledge that information may be processed by Shopify and other service providers needed to operate the store, process payments, prevent fraud, deliver orders, and provide support.

24. Severability

If any part of these Terms is found invalid or unenforceable, that part will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

25. No Waiver

If BRIELLEV does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

Any waiver must be provided in writing and applies only to the specific matter identified.

26. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, policies, or legal obligations.

The updated version will be posted with a revised “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. Continued use of the website after an update constitutes acceptance where legally permitted.

27. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and other policies displayed at checkout, constitute the agreement governing your use of the website and purchases from BRIELLEV.

If a product page or promotion contains specific terms that conflict with general terms, the more specific terms will apply to that product or promotion to the extent permitted by law.
